Na presente comunicação far-se-á uma análise perfunctória do tema da utilização da prova digital no âmbito da relação laboral, com particular incidência na prova obtida através de mensagens eletrónicas. A prova digital é colocada ao lado dos demais meios de prova dos vários aspetos laborais que os nossos tribunais são chamados a resolver — qualificação do vínculo; tempos de trabalho; trabalho suplementar; despedimento; cessação do contrato por outros meios, etc. –, pelo que se coloca com maior acuidade o problema da utilização dos documentos eletrónicos como meio de prova. Nesta análise, passaremos em revista a questão da aportação da prova ao processo, a questão da licitude da obtenção da prova e a questão do valor da prova obtida.
This communication briefly analyzes the use of digital evidence in the employment relationship, especially the one obtained through electronic messaging. Digital evidence is placed side by side with other means of evidence when it comes to the legal issues that labour courts are called to decide upon - qualification of the contract; working time; overtime work; dismissal; termination of contract by other means, etc.. The use of digital evidence hence requires a closer scrutiny, since its use has become so important. In this work we will review the main aspects on how to present this type of evidence in court, the legality of evidence collection methods and the value of the evidence obtained.
