Abstract(s)
A presente dissertação versa sobre o direito à greve e tem como base de investigação uma greve dos enfermeiros ocorrida nos anos de 2018 e 2019, que ficou conhecida como “Greve Cirúrgica”. Esta greve ocorreu nos meses de novembro e dezembro de 2018 e em fevereiro de 2019, e afetou o setor de emergência e os blocos operatórios, causando o adiamento de milhares de cirurgias.
Esta greve envolveu duas associações sindicais, a ASPE e o SINDEPOR, sendo que a questão mais notória, incluindo do ponto de vista jurídico, prendeu-se com a criação, por parte de um grupo cívico de enfermeiros, de um fundo colaborativo ou “crowdfunding” numa plataforma informática disponível para o efeito, para angariação de verbas monetárias para apoio da greve. A legalidade desta greve foi amplamente discutida devido à criação deste fundo de financiamento, tendo surgido dúvidas quanto à possibilidade desta operação estar a encobrir práticas de concorrência desleal ou de branqueamento de capitais, em consequência do que a greve, a atividade das plataformas informáticas de fundos colaborativos e a própria Ordem dos Enfermeiros foram objeto de investigações.
A ocorrência de uma greve que afete o setor da saúde cria ainda problemas de concretização e realização de direitos fundamentais, visto que a greve é um direito fundamental consagrado constitucionalmente, mas o seu exercício pode coartar a realização do direito fundamental à saúde dos utentes, que veem a sua proteção diminuída pelo adiamento de cirurgias e respetivos cuidados de saúde. Embora tenham sido estipulados serviços mínimos, deu-se a necessidade de o governo decretar uma requisição civil, visto que estes serviços mínimos não estavam a ser cumpridos em alguns centros hospitalares.
Esta greve causou impactos incalculáveis aos utentes, visto que foram três meses em que os serviços hospitalares foram afetados pela realização da greve. Contudo, os próprios cidadãos participaram, de certa forma, na realização da greve, ao contribuírem monetariamente para o crowdfunding criado pelos enfermeiros.

This strike involved two trade union associations, ASPE and SINDEPOR, with the most glaring issue being the creation by a civic group of nurses of a collaborative fund, or ‘crowdfunding’ on a computer platform for this purpose, to raise money to support the strike. The legality of this strike was highly debated due to the creation of this funding fund, and doubts were also raised as to whether this operation was covering up unfair competition or money laundering practices, so the strike and the activity of the crowdfunding platforms and the nurses' organisation itself were the subject of investigations. The occurrence of a strike affecting the health sector also creates problems for the realisation of fundamental rights, since the strike is a constitutionally enshrined fundamental right, but its exercise has inevitably hindered the realisation of the fundamental right to health of users, who have seen their protection hindered by the postponement of surgeries and respective health care.
