O direito à greve é um direito irrenunciável do trabalhador e está constitucionalmente tutelado, sendo este a abstenção coletiva dos trabalhadores à prestação de trabalho, com o fim de satisfazer determinados interesses ou objetivos comuns.
Contudo, com o avançar das tecnologias tornou-se relevante estudar o seu impacto particularmente no direito à greve.
Como a legislação nada nos diz sobre a proibição da substituição dos trabalhadores grevistas por robots, procurámos encontrar uma solução para tal possibilidade. Assim sendo, concluímos que a aplicação do art.9.º, em união com o art.535.º do CT seria o mais viável, de modo a prever a garantia do direito à greve dos trabalhadores.
The right to strike is an inalienable right of the worker and is constitutionally protected. It is the collective abstention of workers from providing work in order to satisfy certain common interests or objectives. However, with the advance of technology, it has become important to study its impact, particularly on the right to strike. As the legislation does not tell us anything about the prohibition of replacing striking workers with robots, we tried to find a solution to this possibility. We therefore concluded that the application of Article 9, in conjunction with Article 535 of the CT, would be the most viable way of guaranteeing workers' right to strike.
