Abstract(s)
A presente dissertação insere-se no âmbito do estudo do contrato de locação
financeira imobiliária de prédio urbano e a aplicação do regime da execução específica
previsto no art.º 827º e seguintes (ss) do Código Civil (CC).
O contrato de locação financeira é amplamente utilizado em Portugal, quer tenha
como objeto bens móveis sujeitos ou não a registo, bem como bens imóveis, considerando
que resulta como uma alternativa ao financiamento para aquisição de determinado bem,
permitindo, o gozo e fruição daquele pelo locatário sem que despenda do valor inerente à
sua aquisição, possibilitando, assim, que este não se descapitalize e proceda à gestão
financeira de forma mais equilibrada.
Ora, denotando-se a atual “crise imobiliária” decorrente, entre outros motivos, da
sobrevalorização dos imóveis em Portugal e da dificuldade na obtenção de crédito para
aquisição de habitação própria e permanente, considera-se pertinente o estudo da aplicação
do regime da execução específica ao leasing imobiliário com o objetivo de alargar a
proteção dos sujeitos contratuais e promover a celeridade processual e o desenvolvimento
da economia.
Apraz, assim, proceder à análise do decreto-lei nº10/91, de 09 de janeiro, que previu
a aplicação da execução específica ao contrato de leasing, tendo em conta que o regime
legal atual da locação financeira, regulado pelo decreto-lei n.º 149/95, de 24 de junho, não
prevê o recurso à execução específica, por forma a apurar se, atendendo às atuais
circunstâncias do mercado imobiliário, faria sentido prever-se, novamente, a sua aplicação
no âmbito deste contrato em específico.
Destarte, o presente estudo será estruturado por três capítulos, sendo o capítulo I
dedicado ao estudo da locação financeira. Por sua vez, o capítulo II prossegue o estudo da
locação financeira imobiliária e por fim o capítulo III ocupar-se-á da execução específica
na locação financeira imobiliária.
This dissertation is part of the study of the real estate leasing contract of an urban building and the application of the specific performance regime provided for in article 827 et seq. (ss) of the Civil Code (CC). The financial leasing contract is widely used in Portugal, whether it has as its object movable property subject to registration or not, as well as immovable property, considering that it results as an alternative to financing for the acquisition of a certain asset, allowing the enjoyment and enjoyment of it by the lessee without spending the value inherent to its acquisition, enabling, Thus, that it does not decapitalize and proceeds with financial management in a more balanced way. Now, denoting the current "real estate crisis" due, among other reasons, to the overvaluation of real estate in Portugal and the difficulty in obtaining credit for the acquisition of own and permanent housing, it is considered pertinent to study the application of the specific execution regime to real estate leasing with the aim of extending the protection of contractual subjects and promoting procedural speed and the development of the economy. It is therefore pleased to proceed with the analysis of Decree-Law No. 10/91, of January 9, which provided for the application of specific performance to the leasing contract, taking into account that the current legal regime of financial leasing, regulated by Decree-Law No. 149/95, of June 24, does not provide for the use of specific performance, in order to determine whether, Given the current circumstances of the real estate market, it would make sense to provide for its application again within the scope of this specific contract. Thus, the present study will be structured by three chapters, with chapter I dedicated to the study of financial leasing. In turn, Chapter II continues the study of real estate financial leasing and finally Chapter III will deal with the specific execution in real estate financial leasing.
