Regulamentos Municipais e Legística: Estudo de caso do Município de Leiria e contributos para a redação regulamentar municipal

| dc.description.abstract | Os regulamentos municipais, enquanto normas jurídicas gerais e abstratas emanadas no exercício de poderes administrativos, representam uma importante fonte de Direito Administrativo, devendo ser claros, coerentes e eficazes, permitindo a segurança dos seus intérpretes, aplicadores e destinatários. Daqui deflui a importância da Legística, enquanto área do saber destinada ao estudo da qualidade e eficácia dos atos normativos, para a conceção de regulamentos municipais. Ante tal consciencialização, a presente dissertação pretende explorar o estado da arte sobre os regulamentos municipais e a Legística, seguindo-se o estudo de caso do Município de Leiria. Neste contexto, são analisados os regulamentos emitidos por esta autarquia local que adotaram o procedimento previsto no CPA. A investigação desenvolvida assume uma abordagem descritiva, adotando uma perspetiva quantitativa e uma vertente qualitativa: primeiramente, os regulamentos foram quantificados e caracterizados segunda a sua tipologia e, em seguida, foram selecionados sete regulamentos para uma análise detalhada das regras de Legística. Os resultados apresentados e discutidos permitiram oferecer uma representação dos regulamentos aprovados pelo Município de Leiria, evidenciando as tendências da sua produção regulamentar e, de forma mais específica, os aspetos relativos à Legística. A análise quantitativa demonstrou que a atividade regulamentar do Município de Leiria se orienta maioritariamente para os sujeitos externos, sem especial relação com a autarquia, visando a regulação das relações externas, no âmbito da sua autonomia regulamentar, que dependem da prática de ato administrativo. A análise qualitativa, centrada na Legística, permitiu concluir que, em termos formais, os regulamentos atendem de forma satisfatória aos princípios da clareza e da uniformização, prosseguindo as práticas consolidadas de organização sistemática. Por outro, em termos materiais, foi possível traçar uma tendência bastante positiva dos regulamentos, por, na sua generalidade, apresentarem a identificação do problema, a exposição dos motivos da necessidade de intervenção regulamentar, o enquadramento legal do âmbito material e antecedentes, a fundamentação administrativa e jurídica e o procedimento regulamentar adotado. Sem prejuízo de tais conclusões positivas, verificam-se também fragilidades quer ao nível da Legística formal quer material. Para além disso, são oferecidos contributos para a redação normativa regulamentar, que poderão orientar futuras investigações ou guias de boas práticas, sendo de evidenciar o seu caráter exclusivamente orientador. | por |
| dc.description.abstract | Municipal regulations, as general and abstract legal norms emanating from the exercise of administrative powers, represent an important source of Administrative Law, and must be clear, coherent and effective, allowing the security of their interpreters, applicators and addressees. From these flows the importance of Legistics, as an area of knowledge intended for the study of the quality and effectiveness of normative acts, for the design of municipal regulations. In view of this awareness, this project intends to explore the state of the art on municipal regulations and Legistics, followed by the case study of the Municipality of Leiria. In this context, the regulations issued by this local authority that adopted the procedure provided for in the CPA are analyzed. The research developed takes a descriptive approach, adopting a quantitative perspective and a qualitative aspect: first, the regulations were quantified and characterized according to their typology and then, seven regulations were selected for a detailed analysis of the rules of Legistics. The results presented and discussed allowed us to offer a representation of the regulations approved by the Municipality of Leiria, highlighting the trends of their regulatory production and, more specifically, the aspects related to Legistics. The quantitative analysis showed that the regulatory activity of the Municipality of Leiria is mainly oriented towards external subjects, without special relationship with the municipality, aiming at the regulation of external relations, within the scope of its regulatory autonomy, which depend on the practice of an administrative act. The qualitative analysis, centered on Legistics, allowed us to conclude that, in formal terms, the regulations satisfactorily meet the principles of clarity and uniformity, continuing the consolidated practices of systematic organization. On the other hand, in material terms, it was possible to trace a very positive trend in the regulations, as they generally present the identification of the problem, the explanatory statement of the reasons for the need for regulatory intervention, the legal framework of the material scope and background, the administrative and legal reasoning and the regulatory procedure adopted. Without prejudice to such positive conclusions, there are also weaknesses both in terms of formal and material Legistics. In addition, contributions are offered to the regulatory normative drafting, which may guide future research or good practice guides, highlighting its exclusively guiding nature. | por |
