Abstract(s)
O presente relatório foi realizado no âmbito do estágio curricular inserido no 2º ano do
Mestrado em Solicitadoria de Empresa.
Foram desenvolvidas, sobretudo, as áreas dos Direito do Trabalho, das Sociedades, dos
Contratos e da Segurança Social.
Começamos o presente Relatório por uma caracterização da entidade de acolhimento e
com uma descrição das tarefas que realizámos ao longo de todo o estágio.
De seguida, versamos sobre o ponto principal do presente relatório que consiste no modo
de cálculo do valor a penhorar, ou seja, se o valor da retribuição correspondente ao
respetivo mês deverá ou não ser somado o valor do subsídio de Natal. A questão prendese
em saber se, nos meses em que o trabalhador recebe prestações complementares (como
os subsídios de férias e de Natal), o valor a considerar para efeitos de determinação do
montante penhorável é a soma das prestações recebidas nesse mês ou o valor de cada uma
das prestações, individualmente consideradas, recorrendo à análise jurisprudencial para o
seu estudo e desenvolvimento.
No decorrer de todo o Relatório vamos abordando e descrevendo a situação prática
experienciada no âmbito do estágio.
This report was written within the curricular internship inserted in the 2nd year of the Master's Degree in Solicitadoria de Empresa. The areas of Labour, Companies, Contracts, Social Security and others were developed. First, we start with a framework characterizing the host entity and what tasks we carried out throughout the internship. Next, we deal with the main point of this report is how to calculate the amount to be seized, that is, whether or not the value of the remuneration corresponding to the respective month should be added to the value of the Christmas subsidy. The question is whether, in the months in which the worker receives supplementary benefits (such as holiday and Christmas allowances), the amount to be considered for the purposes of determining the amount that can be attached is the sum of the benefits received in that month or the value of each of the benefits, considered individually, using the jurisprudential analysis for their study and development. Throughout the Report, we approach and describe the practical situation experienced within the scope of the internship.
